Terms of Service

Please read these Terms of Service ("Terms") carefully before using Space Launch Now. By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Definitions

• "Service" refers to the Space Launch Now website (https://spacelaunchnow.app), the Space Launch Now mobile applications for Android and iOS, desktop applications, and all related services.
• "Subscription" means a recurring paid plan (monthly or annual) that grants access to Premium Features.
• "Premium Features" means functionality available only to paying subscribers or Lifetime Purchase holders.
• "Content" means all text, images, data, notifications, and other materials available through the Service.
• "Lifetime Purchase" means a one-time purchase that grants access to Premium Features for the lifetime of the app and Service, as defined in Section 3.

2. Eligibility & Age Requirement

You must be at least 13 years of age to use this Service (per the Children's Online Privacy Protection Act, COPPA). In jurisdictions where a higher minimum age applies (for example, 16 in certain EU member states), you must meet that higher age requirement. By using the Service, you represent that you meet the applicable minimum age requirement.

3. Subscriptions & Payment Terms

3.1 Subscription Plans

3.2 Free Trial

A 2-week free trial is available with the Annual plan only. The trial automatically converts to a paid annual subscription unless you cancel at least 24 hours before the trial period ends. You may cancel via Google Play or Apple App Store subscription management settings.

3.3 Billing & Payment

All billing and payment processing is handled entirely by Google Play (Android) or Apple App Store (iOS). Space Launch Now does not directly process, store, or have access to your payment information.

3.4 Cancellation

You may cancel your subscription at any time through Google Play or Apple App Store subscription management. Upon cancellation, you retain access to Premium Features until the end of your current billing period. No partial refunds are provided for unused time.

3.5 Refunds

Refunds are governed by the refund policies of Google Play or Apple, as applicable. Space Launch Now does not independently issue refunds.

3.6 Price Changes

We will provide at least 30 days' notice before any subscription price increase takes effect. If you do not agree to a price change, you may cancel your subscription before the new price applies. Continued subscription after the effective date of a price change constitutes acceptance of the new price.

3.7 Legacy Purchases

Users who purchased access under previous pricing or terms retain access in accordance with the terms in effect at the time of their original purchase.

4. Premium Features

Premium Features currently include:

1. Ad-Free Experience — Removal of all advertisements
2. Premium Themes — Additional visual themes and customization options
3. Calendar Sync — Synchronize launch events to your device calendar
4. Advanced Widgets — Enhanced home screen widgets with more data
5. Widget Customization — Customize widget appearance and data sources
6. Notification Customization — Fine-grained control over notification categories and timing

We reserve the right to add, modify, or remove Premium Features at any time. Premium Features are provided on an "as available" basis.

5. User Conduct & Acceptable Use

You agree not to:

• Reverse engineer, decompile, or disassemble any part of the Service (except to the extent expressly permitted by applicable law or the GPLv3 license for source code);
• Use automated tools, bots, scrapers, or crawlers to access or collect data from the Service;
• Redistribute, sublicense, or resell access to the Service or its Content;
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
• Interfere with or disrupt the Service or servers or networks connected to the Service;
• Use the Service for any unlawful purpose.

6. Intellectual Property

The Space Launch Now name, logo, and original content are the property of Caleb Jones. All rights are reserved except as expressly granted in these Terms.

Launch data displayed in the Service is sourced from The Space Devs Launch Library API, subject to their terms of use. News articles are sourced from the Spaceflight News API (SNAPI v4) and are attributed to their original publishers.

The Space Launch Now source code is licensed under the GNU General Public License v3.0 (GPLv3). This open-source license applies to the source code only and does not grant rights to the Service's Content, trademarks, or Premium Features.

7. Push Notifications

The Service uses Firebase Cloud Messaging (FCM) on Android and Apple Push Notification service (APNs) on iOS to deliver push notifications about launch events, status changes, and other updates.

• You can enable or disable notifications globally via your device settings.
• Within the app, you can customize notifications by category, agency, and location.
• Your notification filter preferences are stored locally on your device.
• Your FCM/APNs device token is collected solely for the purpose of delivering notifications you have opted into. It is not shared with third parties for marketing purposes.

8. Disclaimers & Limitation of Liability

8.1 "As Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8.2 No Launch Data Warranty

Launch data, schedules, and related information are provided by third-party sources. We do not guarantee the accuracy, completeness, or timeliness of this data. Launch schedules are subject to change at any time by the launch providers.

8.3 Notification Delivery

We do not guarantee the timing or delivery of push notifications. Notification delivery depends on third-party services (FCM, APNs), device settings, network conditions, and other factors outside our control.

8.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CALEB JONES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

8.5 Force Majeure

We are not liable for any delays or failures in performance resulting from causes beyond our reasonable control, including but not limited to: natural disasters; outages of third-party services (The Space Devs API, Firebase, RevenueCat, Google Play, Apple App Store); internet or power disruptions; and government actions.

9. Termination

We reserve the right to suspend or terminate your access to the Service, without prior notice or liability, for any conduct that we determine, in our sole discretion, violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

We may discontinue the Service (in whole or in part) at any time with at least 30 days' notice to users. In the event of permanent discontinuation, active subscribers will not be charged for subsequent billing periods.

10. Links to Third-Party Sites

The Service may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites or services. We strongly advise you to read the terms and privacy policies of any third-party sites you visit.

11. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions will remain in effect. These Terms constitute the entire agreement between you and us regarding the Service, and supersede any prior agreements.

12. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. For material changes, we will provide at least 30 days' notice via the Service or by other reasonable means before the new terms take effect. By continuing to access or use the Service after revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, please stop using the Service.

13. Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and share your information. By accepting these Terms, you also acknowledge and accept the Privacy Policy.
